Legal
Terms and Conditions
Last updated: July 20, 2026
1. Purpose of the service
Pokit is a software-as-a-service (SaaS) platform that lets businesses (the “Users” or the “Business”) design, issue and manage digital loyalty cards — points, stamps or membership — that their end customers can add to Apple Wallet and Google Wallet. The service comprises the admin dashboard, the issuing and updating of passes, push notifications, geolocation features, the public API and the related documentation (together, the “Service”).
2. Acceptance of the terms
By creating an account or using the Service, you represent that you are of legal age, have the legal capacity to enter into binding obligations and, where applicable, have sufficient authority to represent the Business on whose behalf you act, and you agree to be bound by these Terms and Conditions (the “Terms”) and by the Privacy Notice. If you do not agree, do not use the Service.
3. Accounts and registration
- To use the Service you must create an account with truthful, complete and up-to-date information.
- You are responsible for keeping your credentials confidential and for all activity carried out from your account, including actions performed with your API keys.
- We recommend turning on the two-factor authentication available in the dashboard.
- You must notify us immediately at hola@pokit.mx of any unauthorized use of your account.
- Each account corresponds to a single Business; sharing an account between different businesses or reselling access to the Service is not permitted.
4. Acceptable use
When using the Service, you agree not to:
- Use it for unlawful, fraudulent or deceptive purposes, including issuing passes that impersonate third parties or other businesses.
- Send push notifications with content that is illegal, defamatory, discriminatory or unrelated to the Business's loyalty program.
- Collect sensitive personal data from end customers through the platform.
- Attempt to breach the security of the Service, access data from other accounts, or carry out reverse engineering or unauthorized penetration testing.
- Deliberately overload the infrastructure, circumvent the API's rate limits or automate the mass creation of accounts.
- Use the Service in breach of the terms of Apple Wallet or Google Wallet, or of any applicable regulation.
Failure to comply with this section entitles Pokit to suspend or cancel the account in accordance with section 11.
5. Business content and end customer data
The Business retains ownership of the logos, trademarks, text and other content it uploads to the platform, and grants Pokit a limited, non-exclusive and revocable license to reproduce it solely in order to provide the Service (for example, to render passes in the wallets).
With respect to end customers' personal data, the Business acts as the data controller and Pokit as the data processor, on the terms described in the Privacy Notice. The Business undertakes to have its own privacy notice and the necessary consent from its end customers.
6. Intellectual property
The Service, including its software, design, interfaces, documentation, the “Pokit” brand and logos, is owned by Pokit or its licensors and is protected by Mexican and international intellectual property law. These Terms do not transfer to you any ownership rights in the Service; they only grant you a limited, non-exclusive, non-transferable and revocable license to use it in accordance with these Terms while your account is active.
7. Use of the API
- The API is accessed with keys issued from the dashboard. Keys are confidential; you are responsible for safeguarding them and for rotating them if you suspect they have been compromised.
- The API is subject to reasonable rate limits published in the documentation; circumventing them is prohibited.
- Pokit may version the API. Changes that are not backward compatible will be announced at least 30 calendar days in advance through official channels, except for urgent security fixes.
- The integrations you build with the API are yours; how they work and their regulatory compliance are your responsibility.
8. Plans and payments
The prices published on the pricing page are for information purposes and are stated in Mexican pesos. Signing up and using the free plan are currently free of charge. Once paid plans become available: (i) charges will recur for each contracted period; (ii) prices may be updated with at least 30 calendar days' prior notice; and (iii) applicable taxes will be added in accordance with Mexican tax law.
9. Service availability
Pokit makes commercially reasonable efforts to keep the Service continuously available. However, the Service is provided “as is” and “as available”, and may be interrupted by scheduled maintenance (which we will try to announce in advance), force majeure or failures of third parties on which the delivery of passes and notifications depends (including Apple's and Google's services). Guaranteed service levels (SLAs) apply only to customers on the Business plan who have agreed them in writing.
10. Limitation of liability
To the fullest extent permitted by applicable law: (i) Pokit will not be liable for indirect, incidental, special or consequential damages, loss of profits, loss of data or loss of customers arising from the use of or inability to use the Service; and (ii) Pokit's total, cumulative liability to the User for any claim related to the Service will be limited to the amount actually paid by the User to Pokit during the 12 months preceding the event giving rise to the claim or, if no payments were made, to $1,000.00 MXN.
Nothing in the foregoing limits liability that cannot be excluded under Mexican law, including liability arising from willful misconduct or bad faith.
11. Suspension and termination
- You may cancel your account at any time from the dashboard or by writing to hola@pokit.mx.
- Pokit may suspend or cancel accounts that breach these Terms, with prior notice where reasonably possible.
- When an account is canceled, issued passes will stop updating and the data will be retained and erased according to the periods set out in the Privacy Notice.
12. Changes to the terms
We may amend these Terms at any time. Substantial changes will be notified by email or by a notice in the dashboard at least 15 calendar days before they take effect. Continued use of the Service after that date constitutes acceptance of the new Terms.
13. Governing law and jurisdiction
These Terms are governed by the laws of the United Mexican States. For their interpretation and enforcement, the parties submit to the jurisdiction of the competent courts of Mexico City, waiving any other jurisdiction that might correspond to them by reason of their present or future domiciles, without prejudice to the non-waivable rights the User may have as a consumer before Mexico's Federal Consumer Protection Agency (Procuraduría Federal del Consumidor, PROFECO).
